1. Sponsor
Max's Wine Dive LLC, doing business as Max's Wine Dive, 4720 Washington Ave, Suite B, Houston, TX 77007 ("Sponsor").
2. Eligibility
The Nugget Run Monthly Leaderboard Contest (the "Contest") is open to legal residents of Texas who are 21 or older at the time of entry. Employees of Sponsor, their immediate family members and people living in their households aren't eligible to win.
3. Contest periods
Each Contest period is one calendar month. It starts at 12:00:00am Central Time on the first day of the month and ends at 11:59:59pm Central Time on the last day of the month. Sponsor's clock is the official timekeeper.
4. How to enter
Play Nugget Run for free at maxswinedivehtx.com/nugget-run. After a run, submit your score with your initials, a valid email address and confirmation that you're 21 or older, then confirm your email using the link we send. Only confirmed scores are eligible. Each person may hold one spot on the monthly leaderboard, showing their highest confirmed score for that month. Any person using more than one email address, or entering on someone else's behalf, may be disqualified.
5. This is a game of skill
The winner is determined by score, not by chance. Each month's winner is the eligible entrant with the highest confirmed score at the end of the Contest period. If two or more entrants tie, the score submitted first wins.
6. Verification and disqualification
Sponsor reviews top scores before naming a winner. Sponsor may disqualify any score or entrant that appears to involve cheating, including the use of scripts, bots, modified game code or any method that isn't normal gameplay. Sponsor's decisions are final.
7. Prize
One prize is awarded each Contest period: a one-month membership to the Max's Wine Dive wine club. The approximate retail value is $150. The membership includes the benefits offered to wine club members at the time it's redeemed, including six bottles curated by the Max's team. The prize can't be transferred, exchanged for cash or substituted, except that Sponsor may substitute a prize of equal or greater value. The prize is available for pickup only, at 4720 Washington Ave, Suite B, Houston, TX 77007. The winner must be 21 or older and show valid photo ID at pickup. The prize must be redeemed within [60] days of notification.
8. Winner notification
Sponsor will notify the winner by email, and by phone if a number was provided, within [7] days after the Contest period ends. If the winner doesn't respond within [7] days, is found ineligible or can't accept the prize, Sponsor may award it to the eligible entrant with the next highest confirmed score.
9. Publicity
By accepting a prize, the winner agrees that Sponsor may share the winner's name on the Site, in the restaurant and on social media, without further payment, where the law allows.
10. Taxes
Any taxes on the prize are the winner's responsibility.
11. General conditions
Sponsor isn't responsible for technical problems, lost or delayed entries, or errors in the game or leaderboard. Sponsor may cancel, change or suspend the Contest if it can't run as planned, including because of tampering or technical failure. By entering, you agree to these Official Rules and to Sponsor's decisions.
12. Release
By entering, you release Sponsor and its employees from liability for any injury, loss or damage arising from the Contest or the prize, to the extent the law allows.
13. Privacy
Information collected in the Contest is used as described in Sponsor's Privacy Policy at maxswinedivehtx.com/privacy.
14. Governing law
The Contest is governed by Texas law. Any dispute will be handled in the state or federal courts located in Harris County, Texas.
15. Winners list
To request the name of a monthly winner, email marketing@maxswinedivehtx.com within 60 days after the end of that Contest period.
