These Terms of Use govern your use of maxswinedivehtx.com (the "Site"), operated by Max's Wine Dive LLC, doing business as Max's Wine Dive ("Max's," "we," "us"). By using the Site, you agree to these terms. If you don't agree, please don't use the Site.
Who can use the Site
You must be 21 or older to sign up for marketing messages, join the wine club or its waitlist, post a Nugget Run score or enter any contest.
Menus, prices and hours
Menus, prices, hours and events can change without notice. We try to keep the Site accurate, but what's served or charged in the restaurant controls if anything differs.
Reservations, tickets and purchases
Reservations, event tickets, gift cards and online orders are handled by third-party services, including OpenTable, Eventbrite and Toast. Those purchases are also subject to each service's terms. Gift cards are subject to the terms shown at purchase. Alcohol is sold and served only to guests 21 or older with valid ID, in line with Texas law.
Nugget Run
Nugget Run is free to play. Scores you post appear publicly with the initials you choose, so please keep them appropriate. We may remove scores or initials that are offensive, appear to involve cheating, or break these terms. The monthly contest is governed by the Nugget Run Official Rules.
Acceptable use
When using the Site, you agree not to:
- break any law
- interfere with or disrupt the Site or Nugget Run, including by using scripts, bots or modified game code
- try to access accounts, data or systems you're not authorized to use
- submit false information, including someone else's email or phone number
Our content
The Site's content, including text, photos, logos, the Nugget Run game and its characters, belongs to Max's or our licensors. You may not copy or reuse it without permission, except to share links or screenshots for personal, non-commercial use.
Links to other sites
The Site links to services we don't control, such as OpenTable, Eventbrite and Toast. We're not responsible for their content or practices.
Disclaimers
The Site and Nugget Run are provided "as is" and "as available." We don't promise they'll always be available, error-free or secure.
Limitation of liability
To the fullest extent the law allows, Max's isn't liable for indirect, incidental or consequential damages arising from your use of the Site. [Attorney to confirm liability cap language.]
Governing law
These terms are governed by Texas law. Any dispute will be handled in the state or federal courts located in Harris County, Texas.
Changes to these terms
We may update these terms from time to time. When we do, we'll change the effective date at the top of this page.
Text message terms
These terms apply to the Max's Wine Dive text message program.
- What you'll get: recurring automated marketing texts about events, specials and Nugget Run leaderboard news.
- How to join: check the text message box on a Max's signup form and enter your mobile number.
- Consent: joining is optional. Consent isn't required to buy anything, play Nugget Run or win a prize.
- Frequency: message frequency varies.
- Costs: message and data rates may apply.
- Opting out: reply STOP to any message to stop receiving texts. You'll get one message confirming you've been unsubscribed.
- Help: reply HELP, or contact us at marketing@maxswinedivehtx.com or (713) 880-8737.
- Carriers: carriers aren't liable for delayed or undelivered messages.
